Public Act 96-1320

(House Bill 5262)

On 7-27-2010 Governor Quinn signed Public Act 96-1320 into law which allows an employee who was laid off but returned to any State employment to establish creditable service for the period of the layoff, provided that:

• The applicant applies for the creditable service within 6 months after the effective date (7-27-2010) of the amendatory Act;

• The applicant does not receive credit for that period of service under any other provision of this Code;

At the time of the layoff, the applicant was not in an initial probationary status consistent wit the rules of the Department of Central Management Services; and

The total amount of creditable service can not exceed 3 years.

The payment shall consist of:

• Employee contributions based of the rate of compensation earned by the employee on the date of returning to employment after the layoff and the contribution rate then in effect;

• Employer contributions based of the employer's normal(9.44%) cost determined by the Board;

• Plus interest at the actuarially assumed rate (8.5%) on both 1 and 2 calculated from the date of returning to employment after the layoff to the date of payment.

The employee should file a written request to the System providing the dates of the layoff and the agencies involved. If the dates and/or agencies involved are not provided, we will send an "Election to Participate" form 3986 to the applicant.
