   Back Wage Adjustments for AFSCME Employees   

Back Wage Adjustments for Certain Union* Employees at

Department of Human Services, Department of Corrections, Department of Natural Resources, Illinois Human Rights Commission, Department of Public Health and Department of Juvenile Justice


Retirement, Death and Non-Occupational Disability Benefits

Employees at the Department of Human Services, Department of Corrections, Department of Natural Resources, Illinois Human Rights Commission, Department of Public Health and Department of Juvenile Justice who did not previously receive the scheduled union contract raises since July 1, 2011 will need to contact their specific agency to determine when the back wages will be paid. The State Employees’ Retirement System (SERS) will adjust benefits paid to those employees who receive back wages and have retired, or were on non-occupational disability leave, after July 1, 2011. 

SERS cannot adjust retirement benefits until back wages are paid by the agency.  Once back wages are paid and SERS receives the contributions, SERS will adjust any benefit paid (retirement annuity, death benefits, non-occupational disability) retroactively to the original effective date.

Normally SERS receives the retirement contributions within two weeks of you receiving your back wages.  Once contributions are received, our goal is to process the adjustments within one to two months; depending upon the volume received however, processing time may vary.  Additionally, SERS is dependent upon the agency to provide a breakdown of wages. 

If you receive your back wages in multiple payments, SERS will attempt to adjust your benefit each time back wages are paid.  If your adjustment is $10 or more, you will receive a separate check.  Retroactive adjustments of less than $10 will not be paid.

Taxes will be reported based upon the calendar year the payment is made. Group Insurance premiums will not be retroactively adjusted.  Increases to your insurance premium will be processed the month in which SERS processes the adjustment to your benefit payment.

Refund of Contributions

If a member has previously taken a refund of SERS contributions, a separate refund of any additional contributions due the member, as a result of this back wage payment, will be paid as the wage and contribution information is received by SERS.
